Linda Goldstein Discusses Proposed Oracle Act Test of NY’s Influence Over Prediction Markets in Law360

In her recent Law360 article, CM Law Partner Linda Goldstein notes that the rapid rise of prediction markets—from niche platforms to a $60 billion industry—has sparked a high-stakes legal and regulatory debate. She examines how New York’s proposed Oversight and Regulation of Activity for Contracts Linked to Events Act (the “Oracle Act”) could reshape the future of this emerging sector.

Prediction markets allow participants to trade contracts based on the outcome of real-world events, from elections to sporting events. While these platforms are now federally regulated, questions remain about whether they constitute legitimate futures trading or unlawful gambling—and whether federal or state authorities have jurisdiction.

The Oracle Act represents one of the most aggressive state-level responses to date. The legislation would prohibit event contracts across key categories, including sports and politics, while imposing significant penalties and compliance obligations. Notably, it does not exempt federally regulated exchanges, setting up a direct challenge to federal authority.

As Linda explains, the timing is critical. The Commodity Futures Trading Commission (CFTC) has recently shifted toward supporting prediction markets and asserting federal preemption. Meanwhile, courts across the country are issuing conflicting rulings, creating a fragmented legal landscape.

If enacted, the Oracle Act could extend its influence far beyond New York—potentially serving as a model for other states and significantly impacting market liquidity and operations nationwide.

With key litigation pending and regulatory frameworks evolving, the coming months may determine whether prediction markets are ultimately governed as financial instruments or restricted as gambling.
